About the regulations of the societas quaestus - referable to the societas universorum quae ex quaestu veniunt and to the societas unius alicuius negotiationis and unius rei - the interpretative efforts of the Roman jurists were given profusely since the end of the republican age. The scientific monograph puts itself on the traces of identifying the notion of quaestus (gain) with particular reference to the inclusion within it of the so-called remuneration gifts. Furthermore it reconstructs the jurisprudential debate that aroses around the question of whether the socii - in the determination of the shares - had to respect a proportion with the contributions and in this sense with an attempt to explain the existing contrast between a passage from the Digest and one of the Iustiniani Institutiones. Moreover always with specific reference to the societas quaestus the monograph investigates the setting-up of the intempestiva renuntiatio supporting its origin out of the contrast between Proculiani and Sabiniani so far postulated in doctrine. Culture and team production

Abstract This paper addresses theoretically the question whether culture has an effect on economic performance in team production, and what would be an optimal team culture. The members of a team are guided both by economic incentives and by personal norms, weighed according to their prevailing level of materialism. We assume that personal norms evolve following a dynamic driven by a combination of psychological mechanisms such as consistency and conformism. Il saggio analizza le recenti misure di riduzione del costo del lavoro nel pubblico impiego italiano alla luce della degli orientamenti della giurisprudenza al riguardo. La crisi economica è un fattore sempre presente nelle argomentazioni dei giudici. Aumenta il tasso di litigiosità e il potere giudiziario deve valutare la legittimità del-le scelte della pubblica amministrazione e la reazione giudiziaria dei lavoratori pubblici nel tentativo di recuperare, in tutto o in parte, le quote di retribuzione perdute (o non adeguate nel corso del tempo).

The economic crisis is always present in the legal reasoning of the judges. The litigation rate increases and the judicial power must assess the legitimacy of the choices of public administration and the judicial reaction of public workers in an attempt to recover in whole or in part the remuneration quotas lost (or not adequate during the time).

I compensi degli amministratori: analisi della disclosure nei bilanci delle società italiane quotate

This paper analyses the disclosure on the directors’ remuneration, whose primary role in a company, makes their information of particular interest to different stakeholders. The authors’ aim is to investigate the official documents (for 2009) of the 50 most capitalized listed Italian companies, in order to verify the compulsory and/or voluntary disclosure provided about the remuneration paid to their directors. The findings will be summarized in a disclosure index whose correlation with some parameters (selected on the basis of specific research hypothesis) concerning board structure and company size will be assessed.
